1. WHAT INFORMATION DO WE COLLECT?

Personal Information Provided by You

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

The personal information we collect may include:

Usernames

Passwords

Account Setup Information (username, number of children, preferred brands)

Information About Children (Provided by Parents)

When you create a child profile in our Services, we collect the following information about your child with your consent as their parent or legal guardian:

Age, date of birth, and gender

Physical measurements (height, weight, waist, chest, sleeve length, foot length, and foot width)

Current clothing sizes across different brands

Growth tracking data over time

Child's name or nickname (optional, for profile identification)

Photos of clothing items for wardrobe management (compressed and stored as thumbnails)

Wardrobe item details (brand, size, color, type, pattern)

Photos of clothing size tags (processed and immediately deleted - not stored)

This information is collected solely to provide personalized clothing size recommendations and wardrobe management features and is subject to additional protections under COPPA.

Guest User Data

When you use our Services without creating an account (as a guest), you may provide measurements to receive clothing size recommendations. Guest data is not stored on our servers and exists only during your active session.

Information Automatically Collected

We automatically collect certain information when you visit, use, or navigate the Services, including device and usage information, IP address, browser and device characteristics, operating system, and other technical information.

- Google Cloud Vision API (for tag scanning and wardrobe photos)

- Google Analytics (website analytics on tryoutgrow.com)

**Children's Information:** We do not share, sell, or disclose personal information about children under 13 to third parties for marketing or advertising purposes.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We may use cookies and similar tracking technologies to gather information when you interact with our Services. On our website (tryoutgrow.com), we use Google Analytics cookies to understand how visitors use the site. In our mobile application, we use PostHog for analytics, configured in compliance with COPPA.

6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

Our Services offer you the ability to register and log in using your third-party social media account details (like your Google or Apple logins).

7. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice. For children's information, we retain data for as long as your account remains active. When you delete a child's profile or your account, the information is deleted within 30 days and backup copies within 90 days.

9. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organizational security measures. All children's data is encrypted in transit and at rest.

10. DO WE COLLECT INFORMATION FROM MINORS?

Our Services are not directed to children under 18, and children under 13 are not permitted to create accounts independently. However, our Services allow parents to create profiles for their children to receive clothing size recommendations.

11. CHILDREN'S PRIVACY AND COPPA COMPLIANCE

A. Parental Consent

By creating an account and adding a child profile, you represent that you are at least 18 years of age, you are the parent or legal guardian of the child, and you consent to our collection and use of your child's information.

B. Your Rights as a Parent

Under COPPA, you have the right to:

Review the personal information we have collected about your child

Correct any inaccurate information

Delete your child's personal information at any time

Refuse further collection

Withdraw consent

Control who has access through profile sharing

Revoke shared access at any time

C. How We Use and Protect Children's Information

We do NOT:

Use children's information for targeted advertising

Share children's information with third parties for marketing

Allow third parties to contact your child

Require children to provide more information than necessary

D. Fit Feedback Data Collection

When you provide fit feedback, we collect anonymized data to improve our size recommendation algorithms. For users 1,001-10,000, providing 20 unique fit feedback entries earns a free year of access.

E. Profile Sharing Feature

You can share your child's profile with other users through sharing codes. You control access levels and can revoke access at any time.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In some regions (EEA, UK, Switzerland, Canada), you have rights including access, rectification, erasure, restriction, data portability, and objection to processing.

13. DO-NOT-TRACK FEATURES

We do not currently respond to DNT browser signals.

14. US RESIDENTS' PRIVACY RIGHTS

Depending on your state, you may have specific rights regarding access to your personal information. We do not sell or share personal information as defined by state privacy laws.

15. OTHER REGIONS' PRIVACY RIGHTS

Residents of Australia, New Zealand, and South Africa have specific rights under their respective privacy laws.

1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Outgrow Solutions Oy (Business ID: 3594133-7), a company organized under the laws of Finland with its registered office at Hedelmäkatu 1 A, 33270 Tampere, Finland ("Company," "we," "us," or "our"), concerning your access to and use of the Outgrow mobile application, website (including all tools and features available at tryoutgrow.com), and any related services (collectively, the "Services").

By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Services and you must discontinue use immediately.

We reserve the right to make changes or modifications to these Terms of Service at any time. We will alert you about any changes by updating the "Last updated" date.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.

The Content and the Marks are provided on the Services "AS IS" for your information and personal use only. You are granted a limited license to access and use the Services for your personal, non-commercial use.

3. USER REPRESENTATIONS AND ELIGIBILITY

By using the Services, you represent and warrant that:

You are at least 18 years of age

You have the legal capacity and agree to comply with these Terms of Service

You will not access the Services through automated or non-human means

You will not use the Services for any illegal or unauthorized purpose

Your use of the Services will not violate any applicable law or regulation

Children Under 13 and COPPA Compliance:

The Services are not directed to children under 13, and children are not permitted to create accounts independently. When you create a child profile, you represent that you are the parent or legal guardian with authority to provide consent for the collection and use of the child's personal information.

4. USER REGISTRATION

You may be required to register with the Services. You agree to keep your password confidential and will be responsible for all use of your account and password.

5. SUBSCRIPTIONS AND PAYMENTS

5.1 Subscription Plans

**Users 1-1,000:** Free access for life. The first 1,000 users to register receive permanent free access to all Services features.

**Users 1,001-10,000:** May choose between:

Monthly subscription: $1.99 per month

Annual subscription: $19.99 per year

Earn a free year: Provide 20 unique fit feedback entries on items for which we have complete size charts. Once earned, free access remains active for one year.

**Users 10,001 and onwards:** May choose between:

Monthly subscription: $2.99 per month

Annual subscription: $29.99 per year

5.2 Free Trial

Users 1,001 and onwards receive a 7-day free trial period with no credit card required.

5.3 Payment Processing

All payments are processed securely through RevenueCat and your device's app store (Apple App Store or Google Play Store).

5.4 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

5.5 Cancellation

You may cancel your subscription at any time through your account settings or your app store account settings. Cancellations take effect at the end of the current billing period.

5.6 Refunds

Refunds are handled according to the policies of your app store (Apple App Store or Google Play Store).

5.7 Earning Free Access Through Fit Feedback

Users 1,001-10,000 may earn a free year of access by providing 20 unique fit feedback entries on items for which we have complete size charts.

5.8 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will not affect current active subscribers until their next renewal period. Users with lifetime free access will not be affected by price changes.

6. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user, you agree not to:

Systematically retrieve data without written permission

Make unauthorized use of the Services

Circumvent security-related features

Engage in unauthorized framing or linking

Trick, defraud, or mislead us and other users

Engage in any automated use of the system

Interfere with or create an undue burden on the Services

Attempt to impersonate another user

Use information obtained from the Services to harass others

Decipher, decompile, disassemble, or reverse engineer the software

Upload or transmit viruses or harmful material

Disparage, tarnish, or harm us and/or the Services

Use the Services in a manner inconsistent with any applicable laws

7. USER GENERATED CONTRIBUTIONS

The Services may allow you to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content including child profiles, measurements, clothing size information, photos of clothing size tags, photos of clothing items, and wardrobe item details (collectively, "Contributions").

Child-Related Contributions:

When you submit information about your child, you represent and warrant that you are the parent or legal guardian with full authority to provide this information.

Photo Processing:

Photos of clothing size tags are processed to extract brand and size information, then immediately deleted

Photos of clothing items are compressed and stored as thumbnails until you delete them

You should not photograph children wearing clothing items

Profile Sharing:

You may share child profiles with other users through sharing codes. You may grant either View-Only Access or Edit Access. Recipients with Edit Access cannot delete the child's profile or share access with additional users.

8. CONTRIBUTION LICENSE

By posting your Contributions, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide license to use such Contributions for the purpose of providing the Services.

**Privacy of Children's Information:** We will not use, share, or disclose children's personal information except as described in our Privacy Policy and in compliance with COPPA.

9. SERVICES MANAGEMENT

We reserve the right to monitor the Services for violations, take appropriate legal action, refuse or restrict access, remove excessive content, and manage the Services to protect our rights and property.

10. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy at www.tryoutgrow.com/privacy-policy. By using the Services, you agree to be bound by our Privacy Policy.

The Services are hosted in the United States. If you access the Services from any other region, you expressly consent to have your data transferred to and processed in the United States.

11. TERM AND TERMINATION

These Terms of Service shall remain in full force and effect while you use the Services. We reserve the right to deny access to the Services to any person for any reason without notice or liability.

If we terminate or suspend your account, you are prohibited from registering a new account under your name, a fake name, or the name of any third party.

12. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We cannot guarantee the Services will be available at all times.

13. GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

14. DISPUTE RESOLUTION

**Informal Negotiations:** The Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration or court proceedings.

**Jurisdiction:** Any legal action shall be commenced or prosecuted in the courts of Helsinki, Finland.

15. CORRECTIONS

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information on the Services at any time.

16. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Clothing Size Recommendations:

THE CLOTHING SIZE RECOMMENDATIONS PROVIDED BY THE SERVICES ARE BASED ON GENERAL SIZING INFORMATION AND YOUR CHILD'S MEASUREMENTS. ACTUAL FIT MAY VARY BY BRAND, STYLE, AND INDIVIDUAL CHILD. WE DO NOT GUARANTEE THAT RECOMMENDED SIZES WILL FIT YOUR CHILD PERFECTLY.

17. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

OUR LIABILITY WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

18. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand arising out of your Contributions, use of the Services, breach of these Terms, violation of third-party rights, or sharing of profile access with unauthorized recipients.

19. USER DATA

We will maintain certain data that you transmit to the Services. Although we perform regular backups, you are solely responsible for all data that you transmit.

20. ELECTRONIC COMMUNICATIONS

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement.

21. MISCELLANEOUS

These Terms of Service constitute the entire agreement between you and us. Our failure to exercise any right shall not operate as a waiver. If any provision is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the remaining provisions.
